Software Terms and Conditions

Introduction

This Subscription Agreement governs use of the Sites and Services offered by MoveMyTruck Inc and its Affiliates. By accepting this Agreement through clicking to agree, executing a Subscription, or continuing to access the Sites and use the Services, you become legally bound. If you do not agree to these terms, please do not use the sites or services.

The company reserves modification rights with notice provided through reasonable methods including updates posted on this page.

1. Definitions

Affiliate: An entity that controls, is controlled by, or shares common control with the subject entity.
Applicable Law: All laws, rules, statutes, regulations, and policies covering transportation, e-commerce, consumer protection, and intellectual property.
Content: All material featured or displayed on the Sites including text, graphics, photographs, images, videos, and illustrations.
Vehicles: Trucks or other units listed, transported, or delivered through the platform, including those requiring DOT inspection or CDL/Non-CDL qualifications.
Services: Products and services ordered under a Subscription, including listing, bidding, booking, escrow, inspection, transport, and delivery tracking.
Sites: The MoveMyTruck Inc network of websites and applications, including https://movemytruck.com.
User Submissions: Content a User posts or uploads to the Sites, including vehicle listings, photos, reviews, documents, and comments.

2. Use of the Sites and Services

Compliance with Law: Users must comply with all Applicable Laws when listing, booking, or transporting vehicles.

Authenticity of Information: Users represent and warrant that all listed vehicle details (VIN, DOT inspection, insurance, etc.) are accurate and lawful.

Account Security: You are responsible for maintaining confidentiality of account credentials and for all activities under your account.

Prohibited Uses: You may not use the Sites or Services to conduct unlawful transport, misrepresent vehicle conditions, or engage in fraudulent conduct.

3. Marketplace Disclaimer

MoveMyTruck Inc operates as a platform for connecting shippers, carriers, and brokers. We do not inspect, guarantee, or endorse the quality, safety, or legality of vehicles or transport services.

All transactions are made at the sole discretion and risk of the Users.

The company disclaims responsibility for disputes between shippers, carriers, and brokers, including issues relating to inspection, delivery, or payment.

4. User Responsibilities

You must be 18 years of age or older to use the Services.
You agree to provide true, accurate, and current information during registration and maintain updated account information.
You agree not to engage in any activity that could damage, disable, or impair the Sites or interfere with other Users’ use of the Services.
You are solely responsible for ensuring that your listings comply with Applicable Law and that you have the legal right to list and transport vehicles.

5. Fees and Payments

Users agree to pay all applicable fees for use of the Services, including posting fees, broker fees, ancillary fees, and expedited service fees. Fees may be updated by MoveMyTruck Inc with prior notice. All payments must be made in U.S. dollars.

6. SMS Notifications

By registering for an account, you may elect to receive SMS text message notifications related to your account, listings, bids, deliveries, or platform updates. By opting in, you consent to receive such messages at the phone number provided. Standard message and data rates may apply. You may opt out at any time by following the instructions provided in the messages or updating your account preferences. The company is not responsible for any charges incurred from your carrier for receiving SMS notifications.

7. Intellectual Property

All intellectual property rights related to the Sites and Services are owned by MoveMyTruck Inc or its licensors. Users may not copy, modify, distribute, or create derivative works without prior written consent.

8. Disclaimers

Your use of the sites and services is at your own risk. The platform is provided “as is” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

9. Limitation of Liability

In no event shall MoveMyTruck Inc or its affiliates be liable for any indirect, incidental, consequential, or punitive damages arising out of your use of the sites or services. Your sole remedy is to discontinue use of the Sites and Services.

10. Termination

The company may suspend or terminate your access to the Services at any time, with or without cause, and without notice. Upon termination, your rights under this Agreement immediately cease.

11. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the State of Indiana, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in Indiana under the rules of the American Arbitration Association. You and MoveMyTruck Inc waive the right to a jury trial or class action.

12. Miscellaneous

Entire Agreement: This Agreement constitutes the entire agreement between you and MoveMyTruck Inc regarding your use of the Services.

Severability: If any provision is found unenforceable, the remaining provisions remain in effect.

No Waiver: The company’s failure to enforce any right does not constitute a waiver of that right.

Assignment: You may not assign this Agreement without prior written consent.
